We also operate the ESS Alert Engine, an SMS-based notification service that monitors HPD and DOB violations and alerts building owners when new violations are filed against their properties.

2. Information We Collect
We may collect the following types of information:
- Personal Information You Provide: When you sign up for our SMS alert service or contact us, we collect your name, phone number, email address, and property address(es) you wish to monitor.
- Property & Violation Data: We collect property addresses and associated violation records from publicly available sources, including NYC Open Data, the NYC Department of Housing Preservation and Development (HPD), and the NYC Department of Buildings (DOB). This data includes information about lead paint violations, mold complaints, bedbug reports, Local Law 152 gas inspection violations, and other environmental and building code violations.
- Usage Data: We may collect information about how you interact with our website, such as pages visited, time on site, and browser type.
- SMS Communication Records: We maintain records of SMS messages sent and received, including opt-in and opt-out requests.
3. How We Use Your Information
We use the information we collect to:
- Send you SMS violation alert notifications through the ESS Alert Engine when new HPD or DOB violations are filed against your monitored properties.
- Provide information about our environmental compliance and remediation services that may help you resolve identified violations.
- Respond to your inquiries and provide customer support.
- Improve our services, website, and user experience.
- Comply with legal obligations and enforce our terms of service.
4. Information Sharing & Disclosure
We do not sell, rent, or share your personal information with third parties for their marketing purposes.

- Service Providers: We use trusted third-party service providers (such as Twilio for SMS delivery) to operate our alert system. These providers are contractually obligated to protect your information and may only use it to provide services on our behalf.

5. SMS Messaging & Opt-Out
If you opt in to our ESS Alert Engine SMS service, you will receive text message notifications about new violations filed against your monitored properties. Message frequency varies, up to 4 messages per month. Message and data rates may apply.
How to Opt Out of SMS Messages:
- Reply STOP to any SMS message you receive from us to immediately unsubscribe from all future messages.
- Reply HELP to any SMS message for assistance or support information.
- Email us at accounts@ess-nyc.com with the subject line “SMS Opt-Out” to request removal.
After opting out, you will receive one final confirmation message. You will not receive any additional SMS messages unless you re-subscribe.
6. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
7. Data Retention & Deletion
We retain your personal information only for as long as necessary to fulfill the purposes described in this policy, or as required by law.
Request Data Deletion:
You may request that we delete your personal information at any time by emailing us at accounts@ess-nyc.com with the subject line “Data Deletion Request.” We will process your request within 30 days and confirm deletion via email.
